A Yamhill County jail was built in 1857 in Lafayette. A new jail was built by 1878 because the old jail was insufficient. It had two iron cells. The current jail was built in 1968, with major renovations being done in 1997. The jail can hold 244 inmates.

The first Sheriff of Yamhill County was A.J. Hembree. He was one of the earliest settlers of Lafayette. He went on to serve in the last Provisional Legislatures of the Territory of Oregon. He died while fighting in the Indian wars. Another Sheriff was Peter Gates. He fought in the Civil War, rising to the rank of Sergeant Major. After being the Sheriff, he became a state senator for two terms.

In 2004, federal prison guard Robert Stamper was arrested for rape and attempted murder. He had left the 18 year old woman on the side of a logging road after raping and strangling her. The investigation only took 40 hours for the Yamhill Sheriff's Department to know who did it. They arrested him at the federal prison. It then took six months before he was fired. He was charged with attempted aggravated murder, assault, rape, sodomy, and kidnapping. This was the second time he was arrested for a violent attack. The first time, just months before the one in July 2004, he was able to plead guilty to only harassment after originally being charged with assault and domestic strangulation. Stamper told law enforcement he was frustrated with life and wanted to hurt a woman.

In 2009, the people of Newberg were shocked when they found out why Darrin Daily was arrested. He was charged with rape, sodomy, and other charges that were because of trying to get others to join in with having sex with a 14 year old. There were pictures and toys seized, as well. Three men and a woman were charged along with Daily. The computer that was had images of a four year old that was being abused. There was also a 15 year old girl involved. The three men were charged because of responding to the Craigslist ad. The woman was charged with sexual abuse, sodomy and using a child in a display of sexually explicit conduct. Daily pleaded guilty in 2011 and got 40 years in jail.
