The current Bourbon County Jail was built in 2017. It can hold 74 inmates and cost $9 million. The previous jail was built in 1977. It was built to house 27, but was regularly overcrowded. One of the original jails of the county had the money raised for it by a tax bill in 1901.

A famous mobster who was one of the shooters in the Valentine's Day Massacre started his criminal career in Bourbon County. Fred Burke was born and raised in Mapleton, Kansas. His real name was Thomas Camp. He participated in a land fraud scheme at the age of 17 in his home county that bilked a traveling salesman out of money. He fled from getting arrested. He traveled Kansas committing various crimes before moving to Chicago. While in Chicago, he joined the gang of Bugs Moran. It was not long after that he participated in the Massacre.

February of 2014 saw the arrest of county employee Angela Timi. She had stolen almost $24 thousand. She had been employed as a payroll clerk for the Bourbon County Clerk. She was arrested for misuse of public funds and criminal use of a financial card. Both of these are felonies. She was arrested after an investigation by the Kansas Bureau of Investigation.

Donovan Winter, son of former NFL player Blaise Winter, has been in the Bourbon County Jail multiple times. He was a three star football prospect. He was arrested in October of 2017 for criminal threat and battery. The arrest happened on the campus of the Fort Scott Community College. He had also been arrested January of 2017 for armed burglary and theft of a firearm. That incident occurred at the home of his girlfriend and her parents.

On September 16, 1922, Deputy Sheriff William Bloomfield was attempting an arrest on a man who was selling illegal liquor. Bloomfield and the man got into a firefight. Both men were hit. Bloomfield died later that day, while the suspect died a few days later.

November of 2017 saw a plea agreement signed by Joseph Banker, a former employee of the Community Christian Church. He had been arrested for electronic solicitation, sexual battery, and two counts of sexual exploitation of a child. He had been a youth minister at the church.
